TUTOR WITH CONFIDENCE
TERMS AND CONDITIONS OF BUSINESS
1 This document sets out the terms and conditions (the Terms) of business of TwithC Limited (TWC) (trading as Tutor with Confidence). The terms set out the terms and conditions that govern the contract between TWC and its clients. In the Terms Client shall mean the parent, guardian, carer or other person who requests the provision of TWC’s services. There shall be no contract between TWC and the child who is tutored. The terms apply to the exclusion of any other terms and conditions put forward by the Client or by any other person.
2 TWC shall have no obligation to provide any services and no contract shall be formed unless and until TWC expressly agrees in writing to provide the services.
Scope of Services
3 The services to be provided will be as agreed between TWC and the client. Services normally comprise a series of 6 tutoring sessions of 45 minutes duration each. One session per week will normally be held in consecutive weeks. TWC and Client may agree to vary this but no such variation shall be binding unless and until confirmed in writing by TWC.
4 The content and format of the sessions will be as determined by TWC unless TWC and Client agree otherwise in writing.
5 Where tutoring session are provided with a view to sitting entrance exams or towards some other specific purpose or target, no guarantee is given that such entrance exams will be passed or that any other specific purpose or target will be achieved or reached.
Fees
6 Fees are charged per session at the rate agreed between Client and TWC and are normally charged in advance and for full series of 6 sessions. TWC has no obligation to provide or continue to provide any services that have not been paid for in full. Payment of invoices is due upon presentation.
7 Fees can be paid by cheque made payable to TwithC Ltd or by bank transfer to Barclays Bank plc to the following account: account name TwithC Ltd, Sort Code 20-53-77, account number 13691985. Please quote your surname as the payment reference.
8 Cash may be paid to Jane Roberts or Jacqui Wild of TwithC but other tutors are not authorised to accept cash and can give no valid receipt for it.
Missed Sessions
9 If TWC has to cancel or fails to attend a session because of a tutor’s illness or for any other reason TWC will endeavour to rearrange the session for a mutually convenient time as soon as possible. TWC will endeavour to notify Client by telephone as soon as possible after it becomes clear that a session has to be cancelled. If TWC has to cancel a session or if a session is missed by TWC no refund of fees for the cancelled or missed session will be due unless it is not possible to rearrange it for a date and time within 6 weeks of the original scheduled session that had to be cancelled or that was missed.
10 If a Client wishes to cancel a session then not less that 24 hours notice of such cancellation must be given otherwise TWC shall have no obligation to provide that session at some other time. TWC will endeavour to rearrange the session for a mutually convenient time within 6 weeks of the original scheduled session. If less that 24 hours notice of cancellation is given or if the child fails to attend a session without notice, TWC reserves the right not to provide a replacement session in which case no refund will be given.
Location of Tutoring Sessions
11 Tutoring sessions are held at a tutor’s premises or at the Client’s premises as may be agreed between Client and TWC. if the sessions are held at the Client’s premises or other premises nominated by Client, Client shall ensure that the premises are suitable for the session and safe.
Liability
12 Subject as follows, TWC’s maximum aggregate liability to Client whether in contract or in tort for or in respect of any services provided shall be limited to the total fees paid by the Client for the block of sessions in which the act or omission can respect of which TWC is liable took place subject to a maximum amount equal to the fees payable for 6 sessions.
13 Whilst TWC will endeavour to ensure that all services are provided with reasonable skill and care, as stated above no guarantee is given that any child will, as a result of receiving any tutoring services, achieve any particular target or pass any examination.
14 The Terms set out the entire agreement and understanding between TWC and Client and applies in substitution for and to the exclusion of any other terms and conditions. Client acknowledges that TWC has not made and Client has not relied on any warranty representation or statement made by or on behalf of TWC in agreeing to enter into any contract for services with TWC and accordingly TWC shall have no liability to Client for or in respect of any such warranty statement or representation.
15 Nothing in the Terms shall limit or exclude TWC’s liability for death or personal injury caused by TWC’s negligence or that of its employees, contractors or agents or for fraud or fraudulent misrepresentation or for any other matter to the extent that TWC’s liability cannot be excluded or limited by law.

17 TWC reserves the right to vary the Terms at any time. The applicable Terms from time to time are available on www.tutorwithconfidence.co.uk
18 If Client is dissatisfied with TWC’s service Client should follow the complaints procedure on www.tutorwithconfidence.co.uk
